Any links created by the user to this Website should be text links containing the Association’s domain name and which transfer other visitors directly to the Association’s homepage. 4.5 You agree to indemnify and hold the Association, its subsidiaries, affiliates, officers, employees and agents, harmless from any claim or demand, including legal fees on an indemnity basis, made by any third party due to or arising out of your use of this Website; content you submit, post to or transmit to the Website or to the Association; or your violation of these Terms and Conditions or of the rights of any third party.
5. Miscellaneous
5.1 The Association may modify these Terms and Conditions at any time. Such modification shall be effective immediately upon posting of the modified Terms and Conditions on this Website. Accordingly, your continued or subsequent access or use of this Website shall be deemed to be your acceptance of the modified Terms and Conditions.

5.3 The failure of the Association to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision. If any provision of these Terms and Conditions is found by a court of competent jurisdiction to be invalid, you agree that the court should endeavour to give effect to the parties’ intentions as reflected in the provision, and that the other provisions of these Terms and Conditions remain in full force and effect.
5.4 The section headings in these Terms and Conditions are for convenience only and have no legal or contractual effect.
5.5 Notwithstanding anything in these Terms and Conditions, in the event of any dispute, controversy or claim arising out of or relating to the Agreement, no party shall proceed to any form of dispute resolution unless the parties have made reasonable efforts to resolve the same through mediation in accordance with the mediation rules of the The Netherlands Mediation Centre.
5.6 Neither your use of the Website nor these Terms and Conditions creates any relationship of solicitor and client between any of the Association’s officers, employees or agents on the one hand and you on the other, and none of the content of the Website should be construed as legal advice.
